Note: this document is a starter policy written in plain English. It is not legal advice, and we recommend it is reviewed by a qualified lawyer for your jurisdiction before you rely on it.
The short version
- You own your catalogs, products and images.
- Paid plans renew automatically; cancel anytime from your billing page.
- Dodo Payments is our merchant of record and handles payments and sales tax.
- First-time purchases can be refunded within 14 days.
1. About these terms
These Terms of Service ("Terms") govern your use of CatalogKite at catalogkite.com, including the maker, the dashboard, online catalogs and any related apps (together, the "Service"). "We", "us" and "our" mean the operator of CatalogKite; "you" means the person or business using the Service. By using the Service you agree to these Terms. If you use the Service on behalf of a business, you confirm you are authorized to accept these Terms for it.
2. The Service
CatalogKite lets you create product catalogs, line sheets, price lists, order forms and lookbooks, export them as PDF files and publish them as online catalogs that buyers can view and use to send you orders by WhatsApp or email.
You can use the maker without an account. In that case your catalogs are stored only in your browser on your device; we do not receive them, and clearing your browser data deletes them. Creating an account lets you save catalogs to our servers, use them across devices and publish online catalogs.
3. Your account
- You sign in with a one-time code sent to your email address or with Google sign-in. Keep access to your email account secure; anyone who can read your email can sign in to your account.
- You must give a valid email address and keep it up to date.
- You must be at least 18 years old, or the age of legal majority where you live, to create an account.
- You are responsible for activity under your account. Tell us promptly at support@catalogkite.com if you believe your account has been accessed without permission.
4. Plans, billing and taxes
Plans. We offer a Free plan and paid plans (currently Pro and Business). Features and limits for each plan are shown on our pricing page and may change as described in section 13.
Merchant of record. Paid plans are sold through Dodo Payments, which acts as our merchant of record and reseller. When you buy a paid plan, you buy it from Dodo Payments, which processes your payment, issues your receipt or invoice and calculates, collects and remits applicable sales tax, VAT or GST. Your purchase is also subject to Dodo Payments' own terms and policies, shown at checkout. We do not receive or store your full card details.
Billing. Paid plans are billed in advance, monthly or yearly, and renew automatically at the end of each billing period until you cancel. Prices are shown in US dollars; the amount charged at checkout includes any tax due in your location.
Cancellation. You can cancel at any time from your billing page. Cancellation stops future renewals; your paid features remain available until the end of the period you have already paid for, after which your account moves to the Free plan.
Price changes. We may change plan prices. We will give you at least 30 days' notice by email before a price change affects your next renewal, and you can cancel before it takes effect.
Downgrades and limits. If your account moves to a plan with lower limits, your catalogs are not deleted, but the lower plan's limits apply to saving, publishing and exporting. You may need to unpublish or reduce catalogs that exceed them.
5. Refunds
First-time purchases of a paid plan can be refunded in full if you ask within 14 days. Renewals are not refunded. The details are in our refund policy, which forms part of these Terms.
6. Your content
Ownership. You own the content you add to the Service: product data, text, images, logos and the catalogs you create ("Your Content"). We do not claim ownership of it.
Licence to us. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, display and transmit Your Content only as needed to operate, secure and improve the Service for you, including rendering previews and PDFs and serving your published online catalogs. This licence ends when Your Content is deleted from the Service, except for copies in backups that are deleted on our normal schedule.
Published catalogs. When you publish an online catalog, anyone with its link can view it, and it may be shared further by people you send it to. Do not publish anything you want to keep private. Business plan password protection limits access to people who have the password.
Your responsibilities. You are responsible for Your Content, including the accuracy of prices, product descriptions, claims and terms, and for having the rights to the images, trademarks and text you upload. You are responsible for complying with laws that apply to the products you sell and to your dealings with your buyers.
7. Acceptable use
You must not use the Service to:
- Offer or promote products or services that are illegal where you or your buyers are located, including counterfeit goods
- Upload content that infringes someone else's intellectual property or privacy rights
- Publish content that is fraudulent, deceptive, hateful, harassing, sexually explicit involving minors, or that promotes violence
- Send spam or unsolicited bulk messages using catalog links
- Upload malware, or attempt to probe, scan, overload or break the Service or other users' accounts
- Bypass plan limits, rate limits or security measures, or resell the Service without our written permission
- Scrape or copy the Service or other users' published catalogs in bulk
We may remove content or suspend accounts that break these rules, as described in section 10.
8. Orders between you and your buyers
Online catalogs let buyers prepare an order list and send it to you through WhatsApp or email. The message goes directly from the buyer's device to you; CatalogKite does not process payments for buyers, is not a party to any sale, and is not responsible for products, prices, delivery, payment or disputes between you and your buyers.
9. The CatalogKite badge
PDFs and online catalogs created on the Free plan (and without an account) display a small "Made with CatalogKite" badge that links to our website. Do not remove or obscure it except by upgrading to a plan that removes it.
10. Suspension and termination
You can stop using the Service and delete your account at any time from your account settings or by emailing support@catalogkite.com. We may suspend or terminate your access, or remove content, if you materially breach these Terms, if required by law, or if your use creates a security or legal risk for us or others. Where reasonable, we will tell you why and give you a chance to fix the problem first. If we terminate a paid account without cause, we will refund the unused part of your current billing period.
11. Availability and changes to the Service
We work to keep the Service available and your data safe, but we do not promise uninterrupted or error-free operation. We may add, change or remove features. If we remove a core feature of a paid plan, we will give you reasonable notice and, if you cancel because of it, a pro-rata refund of the unused period. We recommend you keep your own copies (PDF exports) of important catalogs.
12. Disclaimers and limitation of liability
The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months before the claim, or US$100 if you have not paid anything.
Nothing in these Terms limits liability that cannot be limited by law, or any rights you have as a consumer under the laws of your country.
13. Changes to these terms
We may update these Terms. If a change is material, we will notify account holders by email or in the app at least 30 days before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not agree, stop using the Service and cancel any paid plan.
14. Indemnity
If you use the Service for business purposes, you agree to indemnify us against third-party claims arising from Your Content or from your breach of these Terms, including reasonable legal costs.
15. Governing law
These Terms are governed by the laws of the country in which the operator of CatalogKite is established, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring claims in your local courts.
